RE: The tariff classification of “sweet chocolate flakes” (Product number M-7PCHF-412) from Belgium

Dear Mr. Forbes:

In your letter dated March 6, 2007, on behalf of Barry Callebaut Canada, of St. Hyacinthe, Quebec, you requested a tariff classification ruling. You indicate that the product contains 55.0 percent sugar, 39.0 percent cocoa paste, 2.5 percent cocoa butter, 2.0 percent dry whole milk, 1.5 percent butterfat and traces of vanillin flavor. The product is in the form of flakes. It will be shipped in 1-kilogram bags and is not packaged for retail sale. The product is intended for use in the decoration of cakes, pastry or ice cream.

The applicable subheading for the “sweet chocolate flakes” will be 1806.20.9900, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Chocolate and other food preparations containing cocoa: Other preparations in blocks, slabs or bars, weighing more than 2 kg or in liquid, paste, powder granular or other bulk form in containers or immediate packings, of a content exceeding 2 kg: Other: Other: Other: Other: Other. The rate of duty will be 8.5 percent ad valorem.
